The formal Judgement document (link below) was delivered by His Honour, Judge Everson on Thu 15 Sep 2022.
In brief, the Judge cited two reasons for dismissal of the appeal – first, he was not convinced by evidence and argument that the proposed development would protect and enhance the health of the central wetlands and second, that the proposed development would be consistent with the established low density residential character of the adjoining Twin Waters residential community. All other issues in dispute such as flood emergency management, Settler’s Park, community expectations and some other relevant matters raised by Stockland were deemed by the Judge to be not reasonable grounds for refusal of the appeal.
